Scott Eizember executed on January 12
Scott Eizember, 62, White, was executed by lethal injection Thursday at Oklahoma State Penitentiary in McAlester.
He was executed for the bludgeoning death of A.J. Cantrell, 76, and to 150 years in prison in the shotgun slaying of Patsy Cantrell, 70, at their Depew home in 2003 (see HoC March 24, 2005). Eizember's attorneys did not deny he killed the couple, but they told the state's Pardon and Parole Board last month that the killings were unplanned and spontaneous
Eizember was also convicted of shooting with intent to kill his ex-girlfriend’s 16-year-old son, and assault with a dangerous weapon against his ex-girlfriend’s mother.
Eizember's breathing became labored and he was declared unconscious at 10:07 a.m. He appeared to stop breathing at 10:10 a.m. He was pronounced dead at 10:15 a.m.
In December, the Oklahoma Pardon and Parole Board voted 3-2 to deny Eizember elemency.
The board’s decision meant Gov. Kevin Stitt could not change Eizember’s death sentence to life in prison without the possibility of parole.
In Oklahoma, a governor can commute a death row inmate's sentence only if the board recommends clemency.
On Monday, Eizember filed a last-minute lawsuit seeking to have his spiritual adviser, the Rev. Dr. Jeff Hood, with him inside the death chamber during his execution after the Department of Corrections rejected the minister because of Hood's history of anti-death penalty activism, including arrests. The DOC reversed course on that decision Wednesday, citing concerns from the Cantrell family that the decision could lead to Thursday's execution being called off.
The U.S. Supreme Court ruled last year that states must accommodate the wishes of death row inmates who want to have their pastors pray aloud and even touch them during their executions.
Oklahoma uses a three-drug lethal injection method starting with the sedative midazolam, rendering the person unconscious, followed by a paralytic vecuronium bromide and finally potassium chloride, which stops the heart.
Eizember becomes the 1th inmate to be executed by Oklahoma this year, the 120th overall since the state
resumed executions in 1990, the 3rd this year in the USA and the 1,561st overall since the nation resumed executions on January 17, 1977.
