USA - Indiana. The U.S. Court of Appeals for the Seventh Circuit has overturned the death sentence imposed on Frederick Baer

The U.S. Court of Appeals for the Seventh Circuit has overturned the death sentence imposed on Frederick Baer, 46, White. The court ruled that Baer's lawyer had been ineffective for failing to object to a defective jury instruction that prejudicially limited the jury's consideration of his mitigating evidence and for "deficiently failing to challenge" what it described as a "pattern of prosecutorial misbehavior" that affected the jury's penalty-phase verdict. Baer was sentenced to death on June 9, 2005 in Madison County for killing Cory Clark, 26, and her 4-year-old daughter Jenna on February 25, 2004. Baer had attempted to rape Cory before her death. The Court remanded the case back to Madison County for resentencing.
