NIGERIA: SUPREME COURT AFFIRMS DEATH SENTENCE ON ELECTION DAY KILLER

15 April 2013 :

Nigeria’s Supreme Court affirmed the conviction and the death sentence imposed on Oduak Jimmy for killing one Aniefiok Bassey in 1998.
Delivering judgment, Justice Musa Muhammed held that Mr. Oduak failed to counter the evidence used by the two lower courts to arrive at his conviction.
The appeal is against the judgment of the Calabar Division of the Court of Appeal.
The appellate court had affirmed the conviction and sentence of the appellant by the Akwa Ibom State High Court made on March 30, 2006.
The appellant was tried and convicted for the offence of murder contrary to Section 319 (1) of the Criminal Code Cap 31 Vol. 2 Laws of Cross River as applicable to Akwa Ibom.
The charge alleged that the appellant killed Bassey on an election day in Effoi Village in Eket Local Government Area of the state.
