MALAYSIA: GARDENER GETS DEATH FOR MURDER

20 March 2013 :

A gardener was sentenced to death by the High Court in Malaysia for murdering an Indian national who was also his house-mate. Judge Datuk Abdul Karim Abd Jalil found Abdul Rahim Abdul Razak, 46, guilty of murdering K. Mohanasundaram, 37, at an unnumbered house at Keretapi Tanah Melayu (KTM) old quarters in Jalan Kampung Orang Asli, Kubang Badak, Tebong, Alor Gajah in Melaka about 7.30pm on Sept 26, 2010.
The victim's body was found floating in a small pond near the Kampung Orang Asli Tebong railway station by a grass cutter on Oct 1, 2010, who then notified the KTM officers and the police.
Abdul Karim said the accused in his defence had claimed that a third person was present during the incident but that was actually the prosecution witness who had taken the stand and testified that he saw the accused stabbing and slashing the victim.
“In view of this, the court finds that the defence has failed to raise any reasonable doubt against the prosecution’s case,” he said.
A total of 13 prosecution witnesses and one defence witness testified at the trial.
Deputy public prosecutor Shahidani Abdul Aziz prosecuted while Abdul Rahim was represented by counsel S Vijayaretnam.
