PAKISTAN: STATUS QUO SULLA PENA DI MORTE

April 18, 2012: ben 313 persone, tra cui sei donne, sono state condannate a morte da vari tribunali pakistani nel 2011, secondo il Rapporto "Stato dei diritti umani nel 2011", pubblicato nel marzo 2012 dalla Commissione diritti umani del Pakistan (HRCP).
Oltre la metà di questi (161) sono stati condannati per omicidio. Altri erano stati accusati di reati quali traffico di droga, sequestro a scopo di estorsione e stupro. Tre persone sono state condannate alla pena capitale per blasfemia.
Per il secondo anno consecutivo il numero di persone condannate a morte ha superato le 300, da aggiungere agli 8.000 e rotti già condannati nel Paese, che ha probabilmente il più grande braccio della morte nel mondo.
Alla fine del 2011, i prigionieri condannati a morte costituivano oltre il 10 per cento della popolazione carceraria del Pakistan. Il numero più alto (6.175) di condannati è stato registrato in Punjab, pari a oltre l'11 per cento della popolazione carceraria pakistana. Le donne nelle carceri del Punjab erano 852, di cui 27 nel braccio della morte.
La moratoria informale delle esecuzioni in atto dal dicembre 2008 è continuata negli anni successivi e nessuno degli oltre 8.000 detenuti del braccio della morte è stato giustiziato. Non ha però avuto seguito la promessa fatta dal governo federale nel 2008 di commutare in ergastolo la pena di morte per tutti i reati eccetto quelli più gravi.
Nel gennaio 2011, i tribunali avevano iniziato a emettere mandati per l'esecuzione di condannati alla pena capitale e la HRCP aveva esortato il governo a bloccare i mandati e a prolungare la moratoria. L'esecuzione dei detenuti è stata rinviata in ottemperanza a una nuova decisione del Presidente Asif Ali Zardari, che ha esteso la sospensione delle esecuzioni fino al 31 dicembre 2011.
La HRCP ha esortato il governo ad accelerare i lavori per rendere permanente la moratoria informale delle esecuzioni. Una petizione è stata presentata alla Corte Suprema per chiedere l'abolizione della pena di morte, perché essa costituisce una violazione della Costituzione. (Fonti: HRCP, marzo 2012)
