GHANA: GIUDICE DELLA CORTE SUPREMA FAVOREVOLE AD ABOLIZIONE PENA CAPITALE

Samuel Kwame Adibu Asiedu, un giudice di Corte d'Appello che è stato nominato in Ghana alla Corte Suprema, il 19 ottobre 2022 si è dichiarato favorevole all’abolizione della pena di morte.
Il giudice Asiedu si è così pronunciato ad Accra, nel corso della seduta pubblica della Commissione per le Nomine del Parlamento, nel suo discorso di accettazione della nomina a Giudice della Corte Suprema.
Il Presidente, nel luglio di quest'anno, ha nominato come giudici della Corte Suprema il giudice Asiedu, il giudice Barbara Frances Ackah-Yensu, il giudice George Kingsley Koomson, tutti giudici della Corte d'Appello, e il giudice Ernest Yao Gaewu, giudice dell'Alta Corte.
Francis-Xavier Kojo Sosu, membro del Parlamento per la circoscrizione di Madina e avvocato per i diritti umani, ha voluto sapere da Asiedu se condividesse l'opinione che la pena di morte debba essere sostituita con l'ergastolo.
Il giudice Asiedu ha ribadito che coloro che si sono espressi contro la pena di morte l'hanno fatto da due o tre angolazioni.
"La vita è preziosa. La vita è così fondamentale e noi come esseri umani non possiamo creare vita e quindi non abbiamo il diritto di toglierla. Una volta che la vita è stata presa, è insostituibile", ha detto. Ha osservato che nel sistema giudiziario esiste la possibilità di commettere un errore; dicendo: “Quindi, una persona può essere condannata, quando in realtà non ha commesso il reato di cui è accusata”.
“E nel frattempo, se viene messo a morte e in seguito emergono prove che dimostrano la sua innocenza, non possiamo riportarla (in vita). “E quindi nessuno dovrebbe essere messo a morte o, per questo motivo, la pena di morte non deve continuare a esistere nei nostri codici”.
Asiedu ha detto che i giudici devono interpretare la legge e applicarla e finché quella punizione rimane nei codici, il giudice non ha altra alternativa che applicarla.
Ha affermato che è stato un passo nella giusta direzione l'avvio di progetti di legge per modificare il Codice penale e di procedura penale, Leggi 29 e 30. "Penso che sia un passo nella giusta direzione", ha detto.
Attualmente circa 27 paesi africani hanno abolito la pena di morte.
Sosu ha detto essere circa 171 le persone attualmente rinchiuse nel braccio della morte in Ghana.
Nel 2010, il governo ha istituito una Commissione di Revisione della Costituzione, che ha raccomandato di sostituire la pena di morte con l'ergastolo.
Sosu ha affermato che le raccomandazioni sono state accettate dall’esecutivo ed è stato pubblicato un libro bianco del governo, ma per oltre 10 anni non è stato fatto nulla al riguardo. Ha aggiunto che attualmente il Parlamento sta esaminando due progetti di legge che mirano a sostituire la pena di morte con l'ergastolo per reati ordinari. "Dico per reati ordinari perché quei disegni di legge non cercano di modificare la Costituzione per quanto riguarda il tradimento e l'alto tradimento", ha detto.
I progetti di legge mirano a modificare il Codice penale, dal momento che quasi tutte le 171 persone nel braccio della morte sono state processate ai sensi di quelle norme, ha concluso.
