KENYA: OPINIONE PUBBLICA E PENA DI MORTE

Un nuovo studio, commissionato da The Death Penalty Project, Londra, in collaborazione con la Kenya National Commission on Human Rights, Nairobi, ha rivelato che, lungi dall'essere fermamente a sostegno del mantenimento della pena capitale, l’opinione pubblica keniota è aperta alla sua abolizione e che gli opinionisti del Paese sono in gran parte favorevoli a tale cambiamento.
La ricerca, guidata dalla prof.ssa Carolyn Hoyle dell'Università di Oxford, ha cercato di comprendere meglio gli atteggiamenti e l'apertura nei confronti dell’abolizione della pena capitale in Kenya.
Attraverso interviste a 1.672 persone, la ricerca ha rivelato che solo poco più della metà dell’opinione pubblica sostiene il mantenimento, mentre quasi tutti i 42 opinionisti intervistati sono fortemente favorevoli all'abolizione della pena di morte. Il 51% del campione inizialmente ha sostenuto il mantenimento della pena di morte, ma solo il 32% è risultato fortemente favorevole.
Il 90% degli opinionisti è favorevole all'abolizione della pena di morte.
La ricerca mostra che quando vengono presentate maggiori informazioni sull'applicazione della pena di morte, incluse circostanze reali dei casi o circostanze attenuanti, come l'età, il background e la salute mentale dell'autore del reato, il sostegno pubblico alla punizione diminuisce notevolmente.
I risultati hanno evidenziato preoccupazioni sia nell’opinioni pubblica che tra gli opinionisti sulla possibilità che persone innocenti possano essere condannate a morte in Kenya.
Il 61% dei cittadini pensa che "molti" o "alcuni" innocenti siano stati condannati a morte in Kenya e queste preoccupazioni hanno ridotto il sostegno al mantenimento della pena di morte al 28%.
Quasi tutti (88%) gli opinionisti ritengono che errori giudiziari si verifichino abbastanza regolarmente.
La ricerca ha anche sondato il grado di accettazione di una politica di abolizione condotta dal governo nonostante la posizione iniziale dei cittadini.
Il 59% dell’opinione pubblica, inizialmente favorevole al mantenimento, ha affermato che avrebbe accettato una politica di abolizione.
Più di tre quarti degli opinionisti credono che i cittadini accetterebbero l'abolizione della pena di morte, nonostante le riserve iniziali, e quasi tutti sosterrebbero un atto del parlamento di abolizione della pena capitale.
In Kenya non vengono praticate esecuzioni dal 1987.
Nel 2017, la Corte Suprema del Paese ha dichiarato incostituzionale la pena di morte obbligatoria e dall'introduzione della condanna discrezionale, in Kenya il numero di condanne a morte comminate è diminuito. Tuttavia, ad oggi, oltre 600 persone rimangono nel braccio della morte.
