USA: CORTE SUPREMA NON ACCETTA CASO SU COSTITUZIONALITÀ DELLA PENA CAPITALE

February 27, 2017: la Corte Suprema degli Stati Uniti non accetta un caso che chiedeva di dichiarare incostituzionale la pena di morte.
Il caso respinto è Marcus Dante Reed v. Louisiana. Come è noto, di solito la Corte Suprema discute singoli aspetti, a volte dettagli della pena di morte: le procedure, i farmaci, il modo con cui i farmaci vengono acquistati, o conservati, o, recentemente, le leggi per tenere segreti i dettagli in modo che la stampa non ne possa parlare.
All’interno di una sentenza del 19 giugno 2015 della Corte Suprema degli Stati Uniti che aveva confermato a stretto margine (5-4) la costituzionalità dell’uso del Midazolam per le iniezioni letali, 2 giudici avevano voluto depositare la loro opinione in dissenso. I giudici Stephen Breyer e Ruth Bader Ginsburg si erano spinti fino a mettere in discussione la stessa pena di morte.
“Sarebbe opportuno trattare una questione più di base: se la pena di morte viola la costituzione. Per come viene amministrata oggi, la pena di morte mostra, da un punto di vista costituzionale, tre difetti fondamentali: è inaffidabile, è applicate in maniera arbitraria, e i suoi tempi molto lunghi minano gli effetti retributivi che dovrebbe avere. Forse non è un caso se molti stati ne hanno abbandonato l’usoâ€. Da allora però tutti i ricorsi che hanno tentato di affrontare l’argomento alla radice sono stati respinti, o più precisamente, “non presi in caricoâ€. Come è noto, la Corte Suprema degli Stati Uniti riceve diverse migliaia di ricorsi ogni anno, ma i casi che vengono affrontati sono, tradizionalmente, circa 100 l’anno. Tutti gli altri casi non vengono respinti nel merito, ma, come si dice in questi casi, “non presi in caricoâ€, il che, in teoria, non significa che siano del tutto privi di fondamento, ma comunque vengono considerati meno rilevanti o urgenti dei casi che invece vengono accolti, e per i quali nei mesi successivi la Corte procede con la discussione. Oggi, nella sentenza Reed v. Louisiana ha votato in dissenso il giudice Breyer, notando cha la condanna proviene dalla Caddo Parish, la contea che ha emesso più condanne a morte di qualsiasi altra contea Usa nella storia moderna. Il fatto che in alcune zone degli Usa coi siano probabilità enormemente più alte di essere condannati a morte rispetto ad altre zone è uno degli argomenti di chi sostiene che questa disparità la rende incostituzionale.  Reed, 39 anni, nero, venne condannato a morte nel 2013 con l’accusa di aver ucciso 3 ragazzi durante una rapina.
Le vittime, nell’agosto 2010, furono i fratelli Jeremiah, Jarquis e Gene Adams, di 20, 18 e 13 anni. Reed sosteneva gli dovessero del denaro per un acquisto di marijuana non saldato. (Fonti: Reuters, whtc.com, 27/02/2017)
