GIAPPONE. AVVOCATI CHIEDONO TRASPARENZA SULLA PENA DI MORTE

September 30, 2005: la Corte distrettuale di Tokyo ha iniziato l’esame del ricorso presentato da Tomoyoshi Emura, un avvocato che chiede alle autorità giapponesi di rendere pubblica la disposizione della camera della morte nel Centro detentivo di Osaka.
“E’ necessario che il Governo rilasci informazioni sul sistema della pena capitale e la sua gestione, affinché l’opinione pubblica possa discutere se abolire a meno la pena di morte”, ha argomentato Emura davanti alla Corte. “Conoscere la disposizione della camera della morte fornirà all’opinione pubblica indicazioni su come vengono praticate le esecuzioni”.
Nel gennaio 2004, il Ministero della Giustizia aveva respinto la richiesta di Emura di rendere nota la disposizione della camera della morte; contro quella decisione l’avvocato ha presentato il ricorso ora all’esame della Corte.
La causa intentata da Emura è la prima nel suo genere in Giappone.
Secondo il Governo – che chiede il rigetto del ricorso - rendere pubbliche informazioni del genere “potrebbe condurre ad evasioni oltre che mettere a rischio ordine e sicurezza pubblica”. Da parte sua, Emura risponde che un rifiuto da parte del Governo dovrebbe essere basato su preoccupazioni concrete, non su astrazioni.
A seguito dell’azione legale intrapresa da Emura, altri avvocati hanno presentato due ricorsi affinché vengano resi pubblici documenti governativi relativi agli ordini di esecuzione ed i rapporti sulle esecuzioni.
Questi ultimi contengono le ultime disposizioni date dai condannati prima di essere giustiziati e le modalità di gestione dei cadaveri dopo l’esecuzione.
I presentatori dei ricorsi sono tutti membri di un comitato della Federazione Giapponese delle Associazioni Forensi (JFBA), già impegnati nella preparazione di progetti di legge per sospendere le esecuzioni capitali.
Chiedono al Ministero della Giustizia di rendere pubblici i documenti relativi al periodo Novembre 2003 – Febbraio 2004.
Toru Motobayashi, a capo del comitato ed ex presidente della JFBA, ha detto alla corte: ”Non si conosce il processo decisionale interno al Governo relativo alle esecuzioni, né si conosce come vengano scelti i detenuti da giustiziare. Non sappiamo come le esecuzioni vengano effettuate. Non sappiamo nemmeno se i condannati sentano dolore”.
“Senza queste informazioni – ha concluso Motobayashi – non possiamo discutere se abolire o meno la pena di morte, né si può assicurare che i condannati a morte abbiano ricevuto un processo equo”. (Fonti: Keiji Hirano via BBC Monitoring Asia Pacific, 30/09/2005)
