UAE: FATHER OF DEAD SON WANTS KILLER DRIVER TO PAY WITH HIS LIFE

15 April 2013 :

A dad is refusing to accept blood money from the driver involved in a crash that killed his son in UAE - demanding instead that the man be given the death penalty.
However, an appeal court judge has refused his request, saying the charge of causing a person’s death does not carry that sentence.
A lower court ordered the driver to pay the family of the victim Dhs200,000, although it did not hand out any other sentence in connection with the accident two years ago. The victim’s father, from Kerala in India, has refused to accept the cash and challenged the verdict at Abu Dhabi Appeal Court.
However, the head of the three-judge panel told the father that the original sentence would stand and said the father must accept the blood money by today or he would not get any compensation. The father has refused to give his written permission to close the case and his lawyer, Amal Al Zaabi, had to fly to Kerala to convince him to come to the UAE.
The man has twice said in court that he could not simply accept money for the loss of his son and wants the killer to face death or life imprisonment. The victim, who worked as a labourer, was killed while crossing a road near Abu Dhabi city centre as he was returning to his accommodation with a fellow worker, who was also injured in the crash.
The driver, who is Indian, was arrested and detained while police investigated the case and was later released. The appeal court said last week that awarding blood money was the fairest way of ending the long-running case.
