10 November 2021 :

The Hamas military court in the Gaza Strip sentenced on 8 November 2021 three residents to death, two of them for collaborating with Israeli intelligence and one for drug trafficking.
Another 11 Palestinians were handed various prison sentences for drug trafficking and spying for Israel, although officials did not specify how many were convicted of each offense.
The “judgments issued have fulfilled all legal procedures. All those convicted were given every legal recourse,” the Hamas court stated on 9 November.
Hamas has sentenced 8 alleged Israeli spies in the Gaza Strip to death over the past month alone.
Based on figures from the B’Tselem rights group and including the fresh cases, some 15 death sentences have been issued this year in the Gaza Strip. At least one of the defendants was tried in absentia.

30 October 2021 :

The Islamist movement Hamas that rules the Gaza Strip announced on 28 October 2021 it had sentenced six Palestinian "informants" to death for collaborating with Israel.
The Hamas military court said it had issued sentences "against a number of informants, including six death sentences, other sentences varying between life terms and temporary hard labour, and one acquittal."
Hamas said on 28 October that collaborators who turn themselves in will face more lenient terms, and said that the "judgements issued have fulfilled all legal procedures."
Palestinian law requires approval from the Palestinian Authority president for the death penalty, but Hamas in Gaza has carried out a number of executions without permission from President Mahmud Abbas.

18 October 2021 :

Hamas authorities in the Gaza Strip on 17 October 2021 sentenced two men to death on allegations that they had collaborated with Israel, according to reports.
A Hamas court ordered that the two men, from Khan Younis and Rafah in the southern Gaza Strip, be hanged.
Reports did not say when the sentence will be carried out.
Two other men were sentenced to hard labor, also for collaborating with Israel.

10 June 2021 :

The Khan Younis Court of First Instance issued a death sentence against the citizen (A.M.) for the charge of premeditated murder, Human Rights and Democracy Media Center “SHAMS” reported on 8 June 2021.
The issuance of the sentence coincided with a brief statement issued by the Higher Judicial Council in the Gaza Strip, which stated that, “murder crimes are amongst the crimes which the judiciary seeks with seriousness and interest to completely end and remove from the active court records. This is done within the judiciary’s policy which purports to shorten litigation periods, achieve civil and social peace, and accomplish public deterrence to reach a safe society that is free from crime.”
This reflects a dangerous policy from which “SHAMS” Center has warned in the past. The policy prioritizes a quick closure of cases, which constitutes an infringement upon guarantees of a fair trial and identification with a culture of vendetta and vengeance.
Simultaneously, this statement reflects an erroneous understanding of the philosophy of deterrence that is rooted in physical punishment rather than one which sets rehabilitation and reform as its ultimate objective.
Therefore, “SHAMS” Center calls upon all effective actors in the justice system in the Gaza Strip to fully respect the right to life, to not violate Palestine’s legal commitments as per the International Covenant on Civil and Political Rights and its second optional protocol that calls for an end to the death penalty, align the national legislations with the Covenant and its protocol, publish them in the official Gazette, immediately stop the systemic violations of constitutional guarantees of the right to life, and intensify civil work against the death penalty in order to eventually abolish it completely.

31 January 2021 :

The Court of First Instance of Deir al-Balah on 27 January 2021 issued a death sentence by hanging against ‘A. Kh ‘A. (25), from Jabalia refugee camp, who was convicted of murdering A. ‘A. N., on grounds of a financial dispute in July 2017.
The Palestinian Centre for Human Rights (PCHR) expresses its full solidarity with the victims of murder crimes in Palestine and supports their rights to access justice and to an effective remedy. In the meantime, PCHR insists on its position that the death penalty is not the only mean to achieve justice or deter those who may attempt to commit such crimes; rather, it is an inhumane way that contradicts with Palestine’s international legal obligations under the 1989 Second Optional Protocol to the International Covenant on Civil and Political Rights, aiming at the abolition of the death penalty.
This is the 2nd sentence of its kind in 2021 in the Gaza Strip. Thus, the total number of death sentences issued in Palestinian territory since 1994 reached 238; 30 in the West Bank and 208 in the Gaza Strip. Among those issued in the Gaza Strip, 149 sentences were issued after the 2007 Palestinian political division.
Since the establishment of the PA, 41 death sentences were executed: 39 in the Gaza Strip, and two in the West Bank. Of those executed in the Gaza Strip, 28 were carried out after 2007 without the ratification of the Palestinian President in violation of Palestinian law.

05 January 2021 :

The Northern Gaza Court of First Instance on 4 January 2021 issued a death sentence by hanging against F. N. (32), from Jabalia refugee camp, who was convicted of premeditated murder of his aunt, Ne’ma Fares al-Nemnem, on 12 December 2015.
According to the Palestinian Centre for Human Rights (PCHR), the death penalty contradicts with Palestine’s international legal obligations under the 1989 Second Optional Protocol to the International Covenant on Civil and Political Rights, aiming at the abolition of the death penalty. Hence, PCHR reiterates its principle position in opposition to the death penalty.
This is the 1st sentence of its kind in 2021 in the Gaza Strip. It should be noted that 2020 witnessed an increase in the number of death sentences in the Gaza Strip, as 22 sentences were issued: 17 were issued by the Court of First Instance and 5 by the Court of Appeal upholding previous sentences. Thus, the total number of death sentences issued in Palestinian territory since 1994 reached 237: 30 in the West Bank and 207 in the Gaza Strip. Among those issued in the Gaza Strip, 149 sentences were issued after the 2007 Palestinian political division.
