USA - Texas. Jimmie Lucero has had his death sentence thrown out by the Court of Criminal Appeals

Jimmie Lucero has had his death sentence thrown out by the Court of Criminal Appeals. The state's highest criminal court agrees with attorneys for Lucero, 52, hispanic, that his trial lawyers did a poor job of investigating his background and presenting mitigating evidence to a Potter County jury that decided in 2005 he should die. The case will now go back to the trial court for a new sentencing trial. Lucero was convicted on May 25, 2005 (see) of capital murder in the Sept. 6, 2003, slayings of 71-year-old Pedro Robledo, his 72-year-old wife, Maria, and their 31-year-old daughter, Fabiana.
