The Nevada Supreme Court has ordered 5-0 a new penalty hearing for Herbert Wesley. Wesley, now 44, was sentenced to die for the March 9, 1992 killing his father. Besides killing his 71-year-old father, Isaac Wesley, Wesley had been sentenced to life imprisonment for killing his 75-year-old stepmother, Doella Wesley. In the latest decision justices said the jury considered an invalid aggravating factor when it sentenced Wesley.
