An Ada County jury has imposed the death penalty for Darrell Edward Payne, 44, white. This was the second time has been sentenced to die for the July 6, 2000 murder, rape and kidnapping of 22-year-old Samantha Maher. Fourth District Judge Thomas Neville first sentenced Payne to death on May 30, 2002 (see) following his conviction by a jury for first-degree murder. He also sentenced Payne to three life sentences for kidnapping, rape and robbery convictions. On June 18, 2008 (see) the Idaho Supreme Court ordered that Payne be resentenced, saying the judge should have limited the victim impact testimony given during the sentencing and some of the statements were unduly prejudicial. Final sentencing is set for April 22.
