BAHRAIN: RESPINTA LA RICHIESTA ONU DI RILASCIARE DUE CONDANNATI A MORTE

Le autorità del Bahrain il 20 giugno 2021 hanno respinto la richiesta di un organismo delle Nazioni Unite di rilasciare e risarcire due attivisti politici anti-regime condannati a morte nel Paese.
Le forze di sicurezza del Bahrein hanno arrestato Hussain Moosa, 34 anni, e Mohamed Ramadhan, 37 anni, nel febbraio 2014, con l’accusa di aver attaccato la polizia "con scopi terroristici" e di un presunto attentato esplosivo, avvenuto nello stesso anno nel villaggio di al-Dair, che provocò la morte di un poliziotto.
Alla fine del 2014, Moosa, un impiegato di hotel, e Ramadhan, una guardia di sicurezza dell'aeroporto internazionale del Bahrain, furono condannati a morte da un tribunale penale.
Entrambi impugnarono le sentenze e i loro casi furono deferiti all'Alta Corte d'Appello penale, che confermò i verdetti nel marzo 2015.
Otto mesi dopo, le condanne a morte furono confermate anche dalla Corte di Cassazione.
Le condanne capitali sono state successivamente annullate dopo l'acquisizione di un referto medico precedentemente non divulgato da parte del Ministero dell'Interno del Bahrein. Il certificato sembrava confermare le affermazioni secondo cui entrambi gli imputati erano stati torturati per rilasciare false confessioni.
Tuttavia, una corte d'appello nel gennaio 2020 ha ripristinato le condanne a morte e nel luglio dello stesso anno la Corte di Cassazione del Bahrain ha confermato le sentenze capitali contro i due attivisti anti-regime.
Lo scorso 17 giugno, il Gruppo di Lavoro delle Nazioni Unite sulla Detenzione Arbitraria ha confermato in un rapporto che i due uomini sono stati "torturati durante i loro interrogatori e costretti a firmare confessioni".
Ha anche invitato il governo di Manama a "rilasciare immediatamente" entrambi gli uomini come "rimedio appropriato" e a "riconoscere loro un diritto al risarcimento e ad altre riparazioni".
Tuttavia, il 20 giugno un portavoce del governo del Bahrein ha dichiarato all'AFP che entrambi gli attivisti sono stati condannati per gravi reati.
Il portavoce ha detto che i funzionari del Bahrein hanno criticato il rapporto dell'organismo delle Nazioni Unite, affermando che è "deludente ... che (il Gruppo di Lavoro) abbia ritenuto opportuno pubblicare un rapporto così unilaterale e disinformato".
Il portavoce del Bahrein ha inoltre affermato che sia Moosa che Ramadhan "hanno ricevuto processi equi con pieno accesso a un procedimento di appello, che ora hanno esaurito".
Secondo il gruppo di cinque esperti delle Nazioni Unite, Ramadhan e Moosa sono stati detenuti per motivi discriminatori basati sulla loro opinione politica, per aver partecipato a proteste a favore della democrazia.
Nel luglio 2020, 16 gruppi per i diritti umani internazionali e del Bahrein hanno invitato il Re del Bahrain Hamad bin Isa Al Khalifa a commutare le condanne a morte dei due uomini, sottolineando che hanno subito torture e ricevuto un processo non equo.
