ALABAMA (USA): GRAZIA POSTUMA PER GLI ‘SCOTTSBORO BOYS’

November 21, 2013: il Board of Pardons and Paroles dell’Alabama ha emesso un provvedimento di “grazia postuma” nei confronti di 3 persone di colore, nel frattempo decedute di morte naturale, che nel 1931 vennero condannate a morte. Lo scorso 4 aprile il parlamento aveva approvato all’unanimità una legge che conferiva al Board il potere di occuparsi anche di casi non attuali.
La legge era stata ispirata dalle vicende dei cosiddetti "Scottsboro Boys", un gruppo di 9 persone di colore condannate nel 1931 per lo stupro di due donne bianche. 8 degli imputati vennero condannati a morte, il nono, che all’epoca aveva 13 anni, venne condannato all’ergastolo.
Negli anni immediatamente successivi al processo emersero molte irregolarità, sia nelle indagini, che nelle testimonianze delle donne (una delle quale ammise di aver mentito) che nella formazione delle giurie popolari, tutte composte di bianchi, sia nell’assegnazione degli avvocati d’ufficio, che fecero molto poco per difendere gli imputati, condannati a morte perché tale era la pena prevista all’epoca per lo stupro di donne bianche da parte di persone di colore.
Dopo una complessa serie di ricorsi e di ripetizioni dei processi, ed iniziative pubbliche supportate dal Partito Comunista Americano e dal NAACP (National Association for the Advancement of Colored People, la principale associazione per i diritti civili dei neri) tutte le condanne a morte vennero commutate in pene detentive, e tutti gli imputati gradualmente ammessi alla libertà condizionale. Le 9 persone nel frattempo sono tutte decedute, l’ultima nel 1989. 6 di loro avevano avuto il tempo di ottenere una “grazia”, che nella procedura statunitense è un passaggio indispensabile se si vuole ottenere un risarcimento dallo stato. Oggi la grazia è stata accordata agli ultimi tre "Scottsboro Boys": Charles Weems, Andy Wright, e Haywood Patterson. Il vice direttore del Board, Eddie Cook, ha commentato: “Oggi abbiamo eliminato una macchia nera che ha persistito sull’Alabama per molti anni”. Il governatore Robert J. Bentley ha detto: “Gli “Scottsboro Boys” hanno finalmente avuto giustizia”. (Fonti: Reuters, N.Y. Times, November 21, 2013)
