INDIA: COURT AWARDS DEATH TO FIVE MEMBERS OF FAMILY

September 8, 2011: Five members of a family have been awarded death sentence by an indian court in a case of honour killing in which the bride's brother-in-law was murdered by her brothers and close relatives.
The 'Shia' girl had married the brother of the victim, who belonged to 'Sunni' sect, against the wishes of her family.
Terming the case as the "rarest of rare", additional sessions judge Bimla Kumari awarded death penalty to Mohammed Saleem, Shaheen Abbas, Sajid Wasim, Shaheen Zargam Ali and Shabbir Kasim, for murdering Tariq, the brother of Sadiq with whom the girl had married. "Since honour killing comes in the category of rarest of rare cases as held by the Supreme Court, I have no option but to award the death sentence to all accused in respect of the offence under section 302 (murder) read with section 34 (common intention) of the IPC," the judge said. The court held all the accused guilty of murdering Tariq in July 2008 in Ballimaran locality as a sequel to the enmity which had developed after the couple had married.
